Also, there does need to be a Substitute Trustee’s Affidavit that the borrowers were alive at the time of foreclosure and not in active military service.My summation - I'm screwed for 4 years.

(Actually I pre-fill most of the form: they just put in bank info and sign) That and a voided check is all that's needed to authorize an ACH pull every month for the duration of the lease.Cost is $3/transaction, with an option for either party to pay or split.I like that inaction on either end results in me getting paid.

If it is in active foreclosure, you don't negotiate with the bank, you negotiate with the owner.

It should have nothing to do with the flooding issue, which is an insurance claim and not something caused by the action or inaction of your tenant.I would return 100% of the security deposit.
