It basically said that the homeowner defaulted on a loan and the debtor had rights to his collateral (which is preferred units in the LLC and "all cash, securities, payments, distributions and other property at any time and from time to time receivable or otherwise distributed.")

If its a smoking hot deal and you're confident beyond a shadow of a doubt that you can make it work, but trust is the biggest issue and they NEED collateral (I would definitely try to just make it an unsecured loan to get around this securitization issue), offer to collateralized other items you own free-and-clear.

Whatever number they give me from a prequalified perspective I'm not going to treat as a true upper threshold, because I think if I found the right property increasing the equity/forced appreciation could help me out.I have a car that is probably worth ~$10k that is completely paid off, so I am considering pledging that as collateral.

Another solution for more cash is to borrow the money needed using that note as collateral, they will still be earning a higher rate than they pay to a bank.Point is to learn what the needs are of the seller, meet those needs, structure the note to meet the needs over a longer term, doing so will be the greatest financial advantage for the seller.

A commercial loan would cross all deeds as collateral and contain providions for partial release meaning each property is pro rata to the illoan balance.Also, Fannie does have a limit to the number of conventionally financed properties.
