If the loan gets called because you moved it into a trust - the burden of proof will now fall on the owner to prove they did NOT violate.Let's just pretend you got summoned to court and had to explain yourself to a judge. 

Tenant(s) Social Security Number: this should have been obtained by the current landlord to do a background check duringthe application process.

It isn't bullet proof, but if you maintain the LLC correctly or are in certain states, your personal assets should be protected from any lawsuit.

Have you shown proof of funds or at least your pre-qual letter to show you are a serious buyer ?

You are losing money every day this crap goes on.A customer must have: 1) A detailed proposal 2) A detailed contract 3) A detailed payment schedule outlined in the contract 4) A written estimated schedule like a Gannt Chart 5) Change Orders every time there is something wanted by you or done by him that is not in the previous documents 6) Proof of payment to subs before final payment 7) Lien Releases

Not that it will solve all your problems with this tenant, but a logging thermometer will supply you proof that the system is working if she starts calling the local housing authorities.

It is difficult to know for sure as landlords weren't able to file the typical eviction paperwork with the courts over the past 16-18 months that would normally be our source of public records.We are now considering asking for proof of the last 2 - 3 months' rent payment (their rent receipts) when these red flags come up.
