I'm still in the Section 121 exclusion window for a property of mine that's appreciated significantly since I bought it.

I was planning on renting it but found out I can do an exclusion of capital gains despite living there less than 2 years, and as a married couple, we can exclude about 220k of gains. 

Once sold, there will be no taxes due to capital gains, due to the $250,000 exclusion.

., the illusion of exclusivity is pretty much out the window.

A sales tactic designed to make you feel exclusive (joining a club) and a pitch that leads with we limit our profit are both red flags.  

If you've already entered into an exclusive buyer-agent agreement with your agent, perhaps you could ask to speak with their broker or ask the agent to show you what they are referring to.Hope this helps!

I reached out to the agent saying that we have other agents watching for properties that fit out needs and we do not want to get into an exclusive arrangement in case another property comes around . . . will see what she says since we have not signed the offer package yet.Another reason to read all 40 pages or so when the come in for signature to make sure you do not miss something like this . . . none of past offer packages have had exclusive agency clauses.

It is amazing how motivated people get when they see in the newspaper they could lose their house.

The second option would be to sell while you still qualify for the section 121 exclusion, take your funds and reinvest. 9/10 in the Oregon market and with the portfolio's I advise on, option 2 is the plan.
