Let her know how many times you attempted to communicate, when you posted notice, the date you entered, etc.

Personally I would let the tenant know you are filing a 30 day notice that will expire at the end of August (if that is the right date?). 

One thing that came up was the internet cables were cut on the outside of the house, and now I know for future showings and inspections to really look at how tenants will hook up to the internet.

For example, going to landlord-tenant court without one seemingly unimportant document with a signature and date on it could cost you months of back rent.

Asides from paying the difference on close date, what strategies can we do to not let this deal fall through?  

The limitation is that if I want the exemption, I have to agree not to rent out the place for 12 months after the date of completion.The only loophole is that if the construction cost is going to be less than 30k, no licensed is needed so no need to apply for the exemption hence no 12 months limitations.
