Great question Nikki.I'm not sure what state you're in, but in GA dual agency is illegal unless written consent is given by both parties (as I think is also the case in most states).

If the previous smoker was a heavy indoor smoker (probably the case in light of the lingering smell) then the odor can penetrate sheetrock more than most people realize.

This is true especially if the owner occupied unit is able to be rented down the road at a profit which appears to be the case in the situation that you described.
