The sad truth is that the bank has to agree and accept the counter offered price they counter you with, receive the paperwork and sign off in order to move on to the next step of the short sale process.

You are going to need the help of a good attorney to sort through this mess and truthfully it maybe cheaper to give up your deposit.

So when you answer "I'm starting to research wholesaling opportunities" or "I'm looking for my first buy and hold duplex" you are telling the truth, and you are telling them what they really asked for.
