The broker will show an accounting of payments made.An individual seller is much more likely, IMO, to manipulate documents, even provide false information anf fly away, so my due diligence is much different.Bigger discounts and purchase prices are probably still obtained by private investors, so as Liz mentioned it's best to find these investors or develop them.

Once a lender always a lender, your interest in the property is that of a collateral interest unless you obtain a deed in lieu of foreclosure, doesn't matter as to the priority of the lien.

After one year in title you can refinance in the secondary market based on the value of the property without regard to the sale price.If your mother goes on the note of a new loan, she can simply add you to the title, more later.Another issue is the amount to be financed, if the property is worth 80k and you put a loan on it for 40k, that low amount may be harder to obtain, but after one year you could get a larger loan and cash out.

I cleared about $55k after resale and holding costs and borrowed $200k so my cash on cash was 85% and I did it in 4 months.This was done in a very, very competitive market of Southern CA where finding good spreads in that type of value range is difficult at best.Most of my acquisitions are REO deals and not short sales, but short pays are a larger majority of the inventory compared to REO so you must work them if you plan to consistently obtain deals.
