The case can be assigned to the buyer and if the tenant did not move when agreed to, it could be enforced by the new owner.Then again, if the tenant gets wind that the property has sold he may bring a defense to court that the old owner can not maintain the eviction and the case could be thrown out leaving the new owner to start over.I am involved in one right now representing the seller.

(this is the only thing we need to negotiate - EQUITY)I will send the seller a contract of sale (and a copy to you) - I always use my "Skinny Contract Offer" at a price we both agreed to -  Your job will be to get comps - look at the property - make an inspection and determine that the offer I make is at a price where we can make a reasonable equity profit.

The inventory is very low for multi-family in my market but rents are good and in high demand with a quality, stable job base here in our rural community.I have an opportunity to purchase a multi-family property from a gentleman who wants out of the business.

You could look more into a Lease Purchase or Land Contract instead where you are doing a seller carry scenario of sorts, then you could re-rent the property and ultimately re-sell the property.
