My understanding of the new IRS regulation to take effect Jan. 1, 2014, is that the "safe harbor for small taxpayers" regulation will allow qualifying taxpayers to avoid having to determine whether an expenditure is an improvement or a repair so long as the total amount spent (per building) is the lesser of $10,000 or 2% of its unadjusted basis.

Download your state landlord tenant laws..Is electric the only issue.. this storm is an Act of God,, and as long as the general area is out, not just your building because of needing repairs,, you would not be responsible to refund rent.. but is it safe to let them return or maintain living conditions.. what's your liability if a fire broke out and no smoke detectors,, they have probably no hot water or A/C..
