Let’s start off with the “I’m not a lawyer, just a pretty well rounded landlord in Lakeland, FL” That’s an interesting question... while  “suggestion of Bankruptcy” is a typical defense in foreclosure cases against mortgage companies, I haven’t seen it used in rentals before (myself)... but that action does usually stay pending litigation, so I could see how it could work - IN THE SHORT TERM.

FWIW an s-corp is used for running "active businesses" where a default state of the typical LLC is tax wise pass through to your personal 1040, the ideal scenario for holding rentals;  in a pass through LLC, where taxes pass through to your 1040 schedule E for rentals.Rental tax regs are actually quite simple for the Schedule E, even the newer 179, di-minimus, and bonus depreciation.

Once you have hit your 10 limit, you would then move on to either Non-QM  / portfolio loans, or you refinance most of your properties into a commercial blanket loan, thereby freeing up your Fannie Mae  / Freddie Mac slots for a new round of 10 loans.The caveat is that when you do the Non-QM / portfolio or the commercial blanket loans, that you are not required to have a personal guarantee on those loans, otherwise if they require a personal guarantee, then the still count in the 10 financed property rule.
