NOTE AGAIN:  I'm NOT saying it's right, but it's the LAW and we must respect it.IMHO, you need to do research on your state's Unified Judicial System and check to see if there are any other arrests for either member of the couple. 

In my case, I have purchased both an 8 unit and a 16 unit via 80% bank financing and the seller carrying a 2nd position note of 10% and 16.5% of the purchase respectively.
