LLCs are established by state statute, so for Federal taxes a single-member LLC is treated the same as a sole-proprietorship for tax purposes, unless the LLC elects S-corp status.

As a foreigner, generally you are subject to a 30% tax rate, but there is an election that I always make for my foreigner clients that own rentals and the election allows you to be taxed based on marginal rates in the US.. same rates that apply to US citizens and residents.

There are likely legislators up for election within the next two years. we are supposed to keep politics out of these discussions, however these laws are created by politicians.
