In this situation, that level of court may determine that they do not have jurisdiction to hear the case, since you and the occupant have not entered into a lease agreement of any sort (verbal or written).

Since, as I mentioned earlier, I will be working with this agent again I'm hoping things will finally smooth out now.I can understand wanting to "smooth things out" & not allow them to hold your other deal hostage, but I'd have serious reservations about entering into any other deals with this broker.
