The IRS has given a safe harbor for establishing intent in Rev Proc 2008-16 that lays out 2 years as a safe harbor given a certain set of criteria.There can always be circumstances that would justify a shorter (or longer) period to establish intent.

Under no circumstances should your standards be lowered to cater in that manner.  

The other factor is, stocks COULD drop significantly due to an unforeseen circumstance such as terrorism.
