If she does not have a viable way to pay her rent quickly, which is likely, then let her know that if she moves out by a specific date, that you will let her out of her lease without charging her any penalties for breaking the lease and you will will forgive the past due rent you are owed.

To add to my above recommendation, make sure to pay close attention to the sold date as well and try to stay within 3 months of the date the comparable closed.

Oncce the final court date was set, he wanted to talk, but we told him that he needed to pay for the past due rent sicne we owner the property.We did say we would not pursue anything further if he left the house in good condition and took all the trash, etc.

There are two exceptions: Nonqualified use does not include any period of such use that occurs :(1) any time during the five-year period ending on the date of sale that occurs after the last day of use as a principal residence, or [ Meaning, of last  5 years, if you  rented a property of last 3 years does not trigger non qualified use, but in the last 5 years, if you first rent for 3 years and then move in for two years as a primary residence, 2/ 5 years is non qualified.](2) any time (up to two years) that the taxpayer is temporarily absent due to change in place of employment, health, or unforeseen circumstances.
