Your issue here was not having a partnership agreement which would preclude one partner from destroying the inherent reason for doing the partnership in the beginning.

The mom/owner still had a mortgage in her name only on the home but has been dead 5 years.  

She can then work on getting buyer leads.Ask top agents in her office if they can refer any leads to her that they don't want to work with. 

Either way I would ignore this court decision as it pertains to Debbies issue and recommend she consult a real estate attorney familiar with the requirements for associations in her state for the best path.

I did a search on the sellers & found that they actually live in here in Houston, TX and the realtor told me she was told they are only vacationing out of the country for awhile.
