The fact the title policy excepted access rather than the commitment requiring an executed agreement makes me think the underwriter also concluded the agreement isn't enforceable as it stands.

@Nathaniel J Mott you should be able to use a standard purchase contract (either Realtor or custom) to execute the basic terms of the deal (purchase price, EMD, DD amount, DD period), then execute an addendum to that contract to iron out the specific terms of the seller financing.

I guess they are adding in more stringent requirements on top of the Fannie guidelines (which state that an executed lease contract should be enough - or so that's what I understand).
