We will be filing suit against the builder, the selling agent and their construction insurance.

i am not a lawyer but.. and no there is no..no.. they cant do a payment plan but they will absolutely take what ever you can pay them and make you think they can. it would slow down the law suit or the sale may be days or weeks at best. 

However, I don't want to be proactive and place a tenant and then find out that this property was much more suited for an owner to live in once everything is brand new.
