@Sorab Gakhar I'd agree you can't really do #4 until after close, a lease is a legal agreement and since you don't have legal right to the property yet I don't see how you could enter an agreement.

In this situation, that level of court may determine that they do not have jurisdiction to hear the case, since you and the occupant have not entered into a lease agreement of any sort (verbal or written).
