My advise would be to do more phone calls to past job references and living situations and ask open ended questions.

He recently had a death in the family and is irritated that I won't give him time for to deal with that, but this has been a problem for long before the death and now he won't return my texts or answer my phone calls. 

Here's a quick test... call the company yourself, see how long they take to answer the phone and how they answer the phone.
