Once you've confirmed there's no legal requirement to do this, like the other said, I'd offer to release them from their lease if they like.

If the EMD is held by a title company they are not supposed to release it unless both parties agree to where it's going.

Now that the parents have passed on the kids want to sell the much smaller older house but the bank wants an appraisal and survey just to even look at releasing the smaller one so that I can buy it.
