The courts will decide what happens, and this varies by state,  but had your tenant carried insurance, they would likely absorb most of the claim, if not all of it.

I told her she could take the landlord to court and get her money back, but she was so grateful that "she gave me a chance, I want to do right by her" ..... really wonderful lady,  they are out there!

I think that if you're repeatedly fined and found in non-compliance, you could end up in court so you need to make sure that your property manager is handling that stuff (and letting you know when its occurring).I have a clause in all my rental agreements that says if I get fined for something the tenant did (like loading up the tree lawn with garbage) - the fine gets passed to the tenant.

Lender is stating this is standard language (purchased standard form etc.LaserPro, Ver. 20.2.20.003)Basically sign away the enclosed rights or we do not furnish the loan.Waives include:- right to a jury- confession of judgement (two different times (one personal, one LLC)- guarantor waiversThere is no comfort in a standard purchased form when the standard form requires waiving rights.Not expecting problems meeting obligations of the loan, and yet does not seem right to waive rights to get the loan.

I personally think vacancy at 5% is too low; it basically means the property is only empty once every 24 months.
