If you've got multiple properties, do this full time, manage your own and generally run it like a business (ie, you take deductions for meals, mileage, phone, internet, etc.... beyond just "investment" expenses), then I'd argue that you're running it as a business and should 1099.But really, when in doubt, 1099.

Don't go trespassing just to find out about the trash cans, toys, flowers, etc, but my understanding is that if you are standing on the public street or on the public sidewalk, anything you can see from that location is knowledge you can use.

My problem with the 3rd (and easiest for the landlord) method is that could end up being quite a few people who don't have a chance of qualifying that end up paying a non-refundable background check etc fee.

I know I probably should have included hold over langue in the original lease or on the Notice of Non-renewal but it's too late for that now so I need to determine a. should I serve another eviction notice?
