The irrevocable trust conforms to Utah Code 25-6-14 as well as Internal Revenue Code 541(c)(2) and is considered a restriction on the transfer of a beneficial interest of the debtor in a trust that is enforceable under applicable nonbankruptcy law - and thus, said restriction is enforceable under federal bankruptcy law.  

In the last few years I have been fortunate to have a number of international (non-US) persons invest in real estate with me.

Among them were Charles Schwab, head of the largest independent steel company; Samuel Insull, president of the world’s largest utility; Howard Hopson, head of the largest gas company; Ivar Kreuger, president of International Match Co., one of the world’s largest companies at that time; Leon Frazier, president of the Bank of International Settlements; Richard Whitney, president of the NewYork Stock Exchange; Arthur Cotton and Jesse Livermore, two of the biggest stock speculators; and Albert Fall, a member of President Harding’s cabinet.Twenty-five years later, nine of these titans ended their lives as follows: Schwab died penniless after living for five years on borrowed money.

The one exception is our {international} student rooming house, where the cash tenants must pay our "Den Mother" by the 1st of the month.This makes the late payment determination quite clear - if the full rent is not in our account by the 1st of the month, it is late.  

In Texas many title companies have gone away from issuing title insurance if a QCD is used except in the case of a family internal transfer.

But the area is growing quickly as well:Add to that an international airport, mild winter temperatures (Mid 50s average), and all the golf, dining and entertainment you could want...what else is there?

So is eviction.Time to create and implement systems for rent collection and an internal policy (and checklist) for eviction, too.The judge gave you the right answer: hire an (unlawful detainer) attorney and do it right. 

You can maximize conversions or be able to better pre-qualify each lead when you have a good script i.e "series of questions"So find a series of pre-qualifying questions "SCRIPT" and internalize the questions and be prepared for certain objection handlers.

As an international investor, with lending rate at approximately 8% and 40-50% down, the COC return (Applying 50% rule) is very low.

Even with a power of attorney, most banks will not allow it.We lend to foreign internationals and we're having trouble setting up accounts for them.Any advice/help will be appreciated.
