I don’t usually let my emotions make decisions, but I’d been on the fence for a while about giving her notice to move out so I could either 1031 the property, move back into it as my primary residence, or convert it to a by the room rental for a better return.

It is so important to make sure that they're covered for a myriad of reasons (ie.make sure that their personal property is covered, along with temporary living expenses - ie. if something happens within the property that forces a tenant to need to stay in a hotel, most renter's insurance policies cover that cost).

Your account is closed lol but I'll answer anyway, the answer depends on the area but typically you can have the seller remove the bath or get a temporary CO/ C of C to allow you to close on the property but you'll be given a finite amount of time to remove it on your own.

If you need the cash for another house, you can refinance your current house or get a second mortgage/heloc to get it (make sure it cash flows though)...This is the plan we originally had for our first house, but listened to “conventional wisdom” and emotions... regret it thoroughly now though.
