This private lender is your financier, they are not your partner, they will not have any control of your project and make sure you're adequately respected on the deal.

My property is not approved for section 8 and I am not intended to apply for section 8 anytime soon either.Can I say something like, "we are not approved for section 8,.....but we follow fair housing and respect any kind of payments"?

By leaving these areas saturated, any wood structure or metal framing is subject to deterioration, and, depending on your locale, will also attract wood destroying insects.IF your rental agreement addresses responsibility for the lawn care, AND, again, you have proof of the damage in the form of "move in condition" documents and photos, I would insist that be restored prior to them vacating.

After taking the time to travel, visit the property (I'm an OOS investor), and the time I've put in on this, you would think out of respect and courtesy I would at least get an email back saying whatever their excuse was (decided they didn't want to sell/ Got a great offer they couldn't pass up, etc.)

Even if the numbers work out well, based on google maps street view and aerial photos, you're looking at a slum situation.
