That doesn't cure the nonpayment of late fee, so you still have cause for termination.However, if the landlord decides to proceed with termination on that basis alone, the tenant has at minimum 38 days before being evicted (can't give notice earlier than 8 days after due date + you must give 30 days notice) which means there's virtually no chance you're getting a rent check for the next month's rent.

All- you don't know their financial situation causing the delinquency.

I don't know, but I think they got a bit lucky because you can't depend on the market to cause appreciation if you don't have a crystal ball.  

Anything that pops up along the way for the person filing it causes a huge delay and or denial of the lien.

Could cause a issue if it went to court and this person did not take care of the  water issue that caused the mold.

The landlord will also have to pay, within 14 days, the same moving costs if the tenant has been issued a 90 day no-cause.
