@John DeanIf it’s going to be owner occupied then you should use a loan servicer as its required by law in most states and for every incorrect statement you send every month you are committing CFPB violations and if the borrower defaults you are technically not allowed to collect interest - in some states if they have a good attorney and default they could wipe you out in legal fees…My bigger question is why would you seller finance?

I've dabbled in the new construction space here in Chicago and there is A LOT that goes into it...I'd highly suggest spending some 1:1 time networking with some other investors like @Jennie Berger or @Prashanth Mahakali who are both Chicago developersYou make your money with the land purchase and then systems/processes/volume over time in the development game, but it's not easy and competition is high!

The purchase would likely need to be consummated at the higher price in order to establish the "damages" to which you are referring... and then I would refer you back to the other potential issues I raised with respect to a negligence claim.Responding to a demand letter with "go pound sand" is not the same thing as defending a lawsuit.I just don't see any attorney taking this $12K case to trial and that is what you are suggesting as the end game.

If i buy the property as myself and then transfer the title to the LLC, it could trigger the pay in full clause.
