The property is now being auctioned and the FINAL SUMMARY JUDGEMENT OF FORECLOSURE mentions the mortgage lender as the Plaintiff and the HOA as the Cross Plaintiff.

I just found out today that my offer for a foreclosure was accepted by the bank...I intend to purchase the property with an FHA construction loan which requires me to live in the house and begin construction within 30-45 days of closing.However,  there are tenants in the house that have a lease with the previous owner that goes through August 2016.
