It doesn't trigger the due on sale clause in the mortgage, and it provide the level of protection you are seeking. 

However, if you are less experience in leases, contracts, negotiations or sales I would leave it to the experts, and as always whether you do it on your own or with a Realtor seek an attorney as well.

If you want the property ask the borrower for a deed in lieu of foreclosure, then you will own it, the incentive for them to do that is that you can not seek any damages or amounts due from them, you accept the property, subject to any liens, as full  payment of the debt created.
