I have had the process explained to me this way: 2 options1)  Allow six months for title seasoning, then do a rehab loan for up to 80% of the ARV, points and escrow fees the whole deal.2) At closing, have clearly articulated on the HUD-1 report who the GC is and have the funds dispersed DIRECTLY to him/her.

My plan is to set up LLC to hold title and pay for the property in cash using the HELOC, then to put a Commercial Loan on the property to coverage purchase price and repairs.  

Because you didn't write in your title or post about being "leary" of out of state lenders, you mentioned a company in particular which I think carries some responsibility of explaining things in a little more detail.

Will the purchase contract from a bank say "delivering clear and marketable title, free of liens or encumbrances" , and if so, then why would I need to pay the cost and time of a title search on a bank owned property?
