I'm not an attorney and my response is based on my experience handling title insurance claims for various underwriters for a number of years and buying foreclosure property in Fl.First, the answer to your questions will vary greatly based on the location of the property and the laws and prior court decisions which control the foreclosure process in that particular jurisdiction.Next, in a judicial mortgage foreclosure, all necessary parties, those who have an interest in the land, must be named in the foreclosure action and provided legal notice of the action and given an opportunity to defend their interest.

The one complication is tenants that have had an eviction filed scrambling to find new housing before the process concludes...there is nothing stopping eviction attorney's from taking money and filing evictions...even if there is no possible outcome

Due to our claims-free history, we are in the process of switching our home, auto and umbrella to a carrier that appears to have the best claims record, which is key to us given the fire history in California where a few of our neighbors have had to go into the high risk pool.The complicating factor I face: we want to keep our options open to offer our home as a PART-TIME short term or corporate rental (so the average rental stay would be 30 to 60 days).
