Cigarettes are legal, and it is legal for landlords to bar the use of cigarettes in their properties.I would assume that if a tenant has a prescription for medical marijuana the landlord must accept the use of marijuana, just as a landlord must accept a medical use pet.

For instance, if every time you come, you say, "While I'm here, I'd like to check all the faucets and toilets and outlets again, just to be thorough... and I might as well also test the smoke detector battieries while I'm here...and can you turn on the stove for me to be sure it's heating, and all the burners, and are all the windows opening?????

Other reasonable accommodations to consider would be visual doorbells, visual smoke/CO detectors, and allowing hearing assistance animals.

With rent subject to change... what if you start the "non-smoker" out at a lower rent rate and they turn out to be a "smoker" or take up smoking later?
