The purchase sub2 the existing mortgage was NOT the cause of any danger or added risk in this transaction, rather the purchase with occupants who had a personal relationship with the seller was the factor which caused this long drawn drama.

@Tony Velez, Good way to follow up.. try to source the area and ask tenant in #2 to try and limit smoking times and areas if possible that's causing the problems,, people with asthma and allergies are more sensitive and could get a doctors note saying they can no longer live in unit due to second hand smoke and you'd be hard pressed to hold them to their lease if you can't solve the issue.

But I would highly recommend that you go NO pets for the property it's simply not worth the expense, and damages that they cause,, you won't regret it and their are plenty of people that rent that don't have pets..
