Tenant complaining about another tenant smoking cigs

Hi,

In our triplex the third floor tenant texted us yesterday complaining about the second floor tenant smoking cigarettes. There is nothing in our lease that forbids smoking cigarettes. We are not sure how to answer the tenants complaint.

Can someone advise us on how we should respond?

Thank you

Tony V

The solution is to add a no smoking clause in your lease at renewal. Put it is every tenants lease.

For the smoker make sure you give them plenty of advance warning of the change to allow you enough time to find a replacement tenant.

Hopefully they will decide to leave because if they stay they will not stop smoking and you will likely end up having to evict.
