From what I understand Probate happens when a beneficiary(ies) has been identified to take over the property and they should have up to date information on them.

I am also thinking we could do a lease option if we can find a buyer before our settlement date, we can collect $4-5k as a down payment.

Just wanted to know if this makes these properties risky or if I could protect myself by making a statement in my offer that the tenant must sign a lease upon closing (or the owner must present an up to date lease).

:(IMO if your going to do a flip and you can do it via sub to then go ahead and do it if the flip from start to sale date is going to be 6 months or less.
