The first Lien Releases are for Progress Payments for every time the sub contractor is paid as the job progresses and the second type Lien Release is a Final Payment Lien Release (can't remember the exact name) for when the job is 100% finished.As the job progresses, the property owner usually writes checks and makes payments directly to the sub contractors.If a sub contractor fails to give the property owner a Preliminary Notice and nobody pays the sub contractor then the sub contractor is poop-out-of-luck and can sue you and file a Mechanics Lien against your property, but the Mechanics Lien will expire within something like 90 to 120 days and if the sub contractor takes you to court he will lose the case.I've been a contractor for 50+ years and the following is a clause in my contracts:"LIEN RELEASE - XYZ CONTRACTOR will never file a Mechanic's Lien on a property unless a payment is not made when due.

Here's the data I included: when the lease expires or if they're month to month, what they're currently paying in rent, what repairs have been done so I can double check that to make sure my property managers are being honest with me, any outstanding issues that I've had questions about that I needed to see the property for, and then after I viewed each property I asked the property manager what they thought it would rent for at current market rates, and strategized about whether to vacate tenants at the end of their leases.

During our conversation last week, the executor/daughter mentioned that she wanted to get rid of her listing agent so badly that she went looking for the contract to see the expiration date/details/etc but couldn't find it.Now, should I communicate to the seller directly privately that I want to do the deal through her and no longer has confidence in closing the sale through this agent of hers?

I always give a signed (by me) term sheet with an expiration date to my borrowers that also requires their signature to bind it.

Make sure she sends a letter to cancel the first sale if the paperwork hasn't already gone through (guessing the dates expired).
