It's a 100-year-old home located in the urban core (64130 - Blue Hills) of Kansas City. 

And if it is silent on the issue then it's likely dependent on State law/precedent as to what rights are conveyed by implication. 

Now that we have started negotiations and he has gone radio silent and is not responding anymore - I’m nervous that he’s going to proceed as business as usual and continue showing and renting his unit as if it includes the lanai. 

It's difficult, but finding a silent partner that will fund deals you find could be a solution.
