I'm not sure why you feel that this is only a 1031 type product.  

Because it is a lien, not a loan, the sellers of these products are not required to play by the same rules (such as disclosure) as regular lenders.

@Richard Chang, Question #1 The world of fractional ownership is the wild west with little regulatory consistency in product or platform.  

The guy is a little expensive but VERY good and because I use him for a number of different products I do get a rather significant discount off his normal hourly rate.Erik

Loan products can't be structured if DTI is too high, which might be the case here.

If you're at the point of looking at props for purchase (as opposed to just generally 'talking' with them about their product) then you should have received a spreadsheet or other specific pro forma ROI calcs for any property you conveyed interest in.
