The EMD is non-refundable to you end cash buyer; as that is how the contract is written. 

Let them know you will be non renewing the other tenants lease.Concentrate on getting rid of the offending tenants.

How much is your property going to appreciate if land is cheap and in high supply, labor is fairly cheap and regulation/zoning is nearly non existent?
