It is not your money it is his and legally he can demand the return of any unused portion at any time.This applicant would not have passed my minimum screening requirements and would have been rejected.

Not your tenant, you didn't screen....no deposits is a BIG RED flag on the people you are probably dealing with and how the landlord handled them before...... my gut is that you probably want them gone any way.....Are you ready to deal with the expenses of clean up, rehab, vacancy etc now or do you financially need the dust to settle for awhile?
