Because they know if they do.....you can report them to the Section 8 office and they risk losing their voucher.

It may be different in your area, but I'll use my experience to explain.Step #1: You find a tenant that has a section 8 voucherStep #2: You and the tenant fill out a contract for section 8Step #3: Sec 8 will inspect the unit, and will tell you what needs fixed to conform to Housing Quality Standards (HQS) They are nearly guaranteed to find SOMETHING you have to fix.Step #4: Once repairs are made, tenant will be given a move in date, and section 8 will determine what the rent will be for the unit, and how much of that rent the tenant will pay based on the tenants income (they cannot pay more than 30% of their income in rent) the Fair Market Rent (FMR) and the utility worksheet (the FMR is reduced based on what utilities the tenant pays).Step #5: Every month Section 8 will pay you their portion (unless there is some issues with the tenant or unit), and you'll have to chase the tenant for theirs.In my experience, Section 8 will not spend the time to inspect a unit until you have a vouchered prospective tenant.

They are computer savvy so they are all paying rent through my online service so I don't knock on doors or get checks in the mail.Of the six houses I recently purchased in bulk, four have Housing Voucher (section 8) tenants where the city pays 75% to 95% of the rent.

have started seeing more and more landlords in socal suburbs actually declaring in ads that they prefer or give 'priority' to sec 8 applicants.considering sec 8 is a 'program' providing an need-based housing voucher deemed countable as 'income'* for 'low-income residents', would preferring applicants of a type of income (in this case, the low-income housing voucher program called section 8) be in violation of FHA act or other federal or state (in my case, CA) statutes?

If you rent to tenants under the Housing Choice Voucher program, formerly called Section 8, which I recommend, the rent you can charge is limited to what the Dept. of Housing and Urban development list in their annual Fair Market Rent study.

Compounding that, if you evict a Section 8 tenant they lose their voucher permanently (at least here), so there's heavy incentive for them to work with you and be good tenants.
