I think one of them would be a Subject To agreement from your brother to an LLC/partnership that you and your brother create that would allow the loan to stay in his name but the LLC would operate the property and earn the cash flow.

If your reason is "I didn't like they way they looked" or "I didn't like their attitude", those are very subjective reasons so just be careful.

There may not be a tax lien of record if the IRS didn't record one but if there is, I believe it would attach to the land and any subsequent owner's interest would be subject to it.
