Tom Brennan Foreclosure without bankruptcy?
22 July 2013 | 8 replies
The judge might give the house to the spouse or order your friend to keep making payments etc.Your friend needs to talk to his divorce attorney to make sure this is handled properly. Also if he has joint credit cards he needs to find a way to close them out.The BIGGEST mistake I see in divorce is thinking that a judge's decree is final and that if the judge tells the other former spouse they are to pay the debt then the other party is off the hook. This is FALSE.Your agreement with a creditor predates the divorce so if your spouse doesn't pay as ordered by the decree you are still on the hook for joint accounts and if you don't pay credit can be severely damaged. Also if you leave the joint account open and the former spouse runs up the card you are equally responsible. That's why you have to cut the chord all the way.I have seen a few divorced couples stay on amicable terms over the years but often they are mad when divorcing or good during the divorce but falls apart a few years later. It can also cause problems to be attached to a past relationship in some way when you are starting new with someone else.Tom I could get very detailed on here but if you have anymore questions just ask.
