The tenant was previously told to keep the area clean of any debris and she is generally on top of things but at the same a pain with requests (she wanted me to install shelving in the basement at my expense, at move-in she said the property wasn't clean because there was 1 hair in the tub -I think we all know this kind of tenant).

You being in 1st position would have to be paid the full amount, they being in second may have to take a hair cut depending on the irs taxes and the value of the home above and beyond what the first lien would be.

The PM says because the hair and who knows what else accumulates over time, that Florida law goes as far to say that it wouldn't be fair to penalize the current user of the property.I could certainly see this if the lease didn't specify, but they are saying we can't put it in the lease that the tenant be responsible for keeping the plumbing fully operational.Thanks to any knowledgable Florida landlords out there!
