If he has a direct deposit set up from pay, grin and bear it with military, you won't win. 

@Justin Fernandez - I think successful negotiation is trying to truly find a win-win scenario and be open with sellers.

In both cases I walk and the builder get the home and can relist for +20%-- he wins, and I'm up s***s creek.To your comment, I guess I am wondering what leverage can I use to say "it's not going to happen?"

We buy all the properties with our own funds and then distribute them to our investor partners who are looking for opportunities to use their funds and or self directed IRAs to generate double digit returns not otherwise available anywhere else so it's been a great win win strategy.  

@Mickey Busanet - While I'd be cautious of advertising how much money you are receiving after winning a lawsuit, I think you already know the answer to your question. 

It's a win win for the tenant.

I have an REO in my portfolio that I can't do anything with because when I foreclosed, a deed showed up with another owner and now I have to sue the other owner, win, then sell the REO.

I am thinking that if I can pull out 25k per property, which would still be below market value, and rent them for 700/mo I would consider that a win. 

I feel like it's almost an impossible situation to win.
