You should be able to supply that to the escrow officer/agent as evidence to receive a credit on your closing statement.

So they will be presenting evidence (pictures, etc) to the judge documenting they lived in a "slumlord's property" who is now trying to unfairly keep their deposit.  

Selling the house will enable you to have a substantial amount of reserves as a sort of solid footing to finance the vacancies for deals just like this one (no job required).Selling with the lease-option or selling outright seems to be the way to go.          

It might be a land play if it's in a solid location.
