Another aspect of requiring someone to use a particular service provider is that if they feel they got messed over by any provider and brought legal action against them you too may be drawn into the suit since you made the requirement.

Your attorney will want to construct the agreement to meet local needs, but these are areas that might be addressed.Many CFDs recite note terms in the CFD and frankly miss many aspects of a good note, so using a good note and incorprating the note in the CFD is much handier, IMO and that way you have a good note to use for seller financed deals as well as financing an option price or a CFD.
