For the railing height, I'd find a local carpenter to ask about completely removing the railing and balusters and doweling in an additional length on them.

I have a local property manager that is co-host on the AirBnb listing that will continue to manage the property.

Others have said they'd only care if the appraiser pointed it out and that I should reach out to some local appraisers to see what they look into. 

Did do the deprecation thing at least last 2 years though  Wife and I FEEL we need to sell in order to use the equity for a down payment in order to stay local.

There is more to this, but another thing I would encourage u do is ask some others for a local attorney that they trust.

We are saying, the action of instructing, or conspiring, to actively take efforts be it via planned intent or active action, is the issue that by all law to the matter I have read is an act of fraud. 

I can't see any local investors continuing on with the new laws.  

Look for mentors by reaching out to people in the real estate field, at local gatherings, REI groups, and on Bigger Pockets forums.

See if you can get to Facebook groups in  your area and also Meetups and get the network broadened so that you can scale quicker than if you are not pro active.. my 2 cents
